Dad’s Divorce posted an answer to an Ask a Lawyer question over where to file for a custody modification after the ex-wife had moved around to several different counties within the state. The simple answer is to file wherever the original decree was issued, as that court will retain jurisdiction until a request is made and approved to move it elsewhere.
Men’s Divorce published a new article regarding financial issues that can arise after a divorce when one party is awarded the home, but both spouses are on the mortgage. Since lenders are not a party to the divorce, they will still hold whoever is on the loan responsible. This makes it imperative for the party awarded the home to refinance the loan into only their name.
