Question:
My wife left us, drained our bank account and took one of our children with her. I would like a divorce but do not know how I am supposed to file without any money for an attorney.
How am I supposed to file the paperwork or get legal advice if I don’t have any money?

Answer:
I am sorry to hear about the grave set of circumstances on your plate right now.
You do not need an attorney to file for divorce; you are allowed to file on your own down at the courthouse.
Simply go to the counter and tell the clerk that you want to file for divorce, and they will give you the necessary paperwork. Be sure to have a certified copy of your marriage certificate with you.
As to the filing fee, if finances are an issue, you can request a hardship waiver for the filing fee. Most jurisdictions allow fees to be waived if one or both parties face financial hardship.
Also, most jurisdictions offer a “Lawyer of the Day” program that is of no cost to you.
You can ask this attorney questions you may have about your case and how to file. I’d recommend starting with a phone call to the family court in your county and to see what information you can get over the phone.
Remember, I am unable to provide you with anything more than tips on your situation, so please consult a domestic litigation attorney in your area to obtain specific advice as to the laws in your state and how they impact your potential case.
