After a father establishes paternity through the child support division, how does he gain visitation rights?
Answer:
In Colorado, since paternity has been established, you can file an action for Allocation of Parental Responsibilities (APR). This is essentially what is commonly referred to as a “custody action,” Colorado simply does not use those terms. As part of the APR action, your visitation schedule will be established; either through agreement with the opposing party or by order of the court.
In Colorado, child support enforcement establishes paternity and your child support obligation only — they do not establish a parenting plan. You would need to file a separate action with the court for the APR action in order to do so. However, since child support is affected by what your parenting time is, child support enforcement would need to be served with a copy of the petition for APR along with the opposing party.
